ELIGIBILITY: CFL Pizza, LLC (“Sponsor”) is sponsoring the Free Pizza for a Year – Text to Win Promotion (the “Promotion”). The Promotion is open to legal residents of the United States who are at least 18 years of age at the time of entry. The Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. The Promotion begins on August 3, 2013 at or about 12:01 a.m. E.S.T. and ends August 3, 2013, at or about 11:59 p.m. E.D.T. (the “Promotion Period”).

HOW TO ENTER: To enter: During the Promotion Period, text the word FREE to 89074 using a wireless, SMS-capable phone. You will receive a reply via text message to which you must respond to in order for your entry to be official. Duplicate entries for an individual will be disqualified. Sponsor assumes no liability for entries it is unable to process for any reason, including hardware, software or other technical failures. All entries become the property of the Sponsor.

WINNER SELECTION AND NOTIFICATION: The one (1) Promotion winner will be selected in a random drawing on or around August 3, 2013, from all eligible entries received during the Promotion Period. The winning entry will receive, for each of 52 weeks, beginning on August 3, 2013, one medium pizza per week, any crust type, 1 topping per pizza. Carryout only. Approximate prize value is $416. Prize may constitute taxable income to winner. Odds of winning depend on the total number of qualifying entries received. The selected winners will be notified by PA announcement or text message (at Sponsor’s sole discretion) and will be required to sign and return an affidavit of eligibility and release of publicity and liability (where permitted by law) during time of prize collection. In the event the winner is selected from a text message entry, the prize will be awarded to the “authorized account holder” associated with the given wireless telephone number used to enter the Promotion. In the event of noncompliance, if the prize winner cannot be contacted using the information provided in the winner’s entry, or if the prize or prize notification is returned unclaimed or undeliverable for whatever reason beyond the control of Sponsor, the prize will be forfeited, and an alternative winner of the random drawing prize may be selected only if time permits and in Sponsor’s sole discretion.

GENERAL TERMS: By entering, all entrants agree to be bound by these Official Rules and by the decisions made by Sponsor regarding administration of the Promotion, which shall be final and binding. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Promotion, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.

Sponsor reserves the right to modify, extend, suspend, or terminate the Promotion, in whole or in part, if it determines, in its sole discretion, that the Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Promotion or particular promotion drawing as contemplated herein. Sponsor reserves the right to substitute a prize equal or greater value in the event a prize is cancelled, delayed or otherwise revised as described above. Sponsor will determine all elements of the prize in its sole discretion. No prize may be assigned, transferred, changed or redeemed for cash, except at Sponsor’s sole discretion, and any portion of the prize not used will be forfeited.

GENERAL LIABILITY RELEASE: Acceptance of a prize constitutes winner’s permission for Sponsor to use winner’s name, image, likeness and voice, together with any actual or fictional material, for advertising, promoting and/or publicity purposes and in any and all forms of media now known or hereafter developed, in perpetuity, without further compensation, where permitted by law. Entrants agree that the Sponsor: (a) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Promotion or any Promotion-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (b) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, or lost prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.

PRIVACY; PERMISSIONS. By entering and providing the required entry information, you acknowledge that Sponsor may use your information to contact you about Sponsor, future promotions, or related purposes. By participating in the Promotion, entrants hereby agree to Sponsor’s collection and usage of their personally identifying information.

DISPUTE RESOLUTION. Except where prohibited, by entering the Promotion, entrants agree that: (1) All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the liabilities, rights and obligations of entrants, Winner or Sponsor and their respective agents shall be governed by and construed exclusively in accordance with the laws of the State of Florida without giving effect to any principles of conflicts of law of any jurisdiction. (2) Any legal action arising out of or relating to the Promotion, or awarding of the prize, shall be filed only in the state or federal courts located in the State of Florida and entrant or Winner hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Promotion, entrant and winner agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or awarding of the prizes, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Promotion but in no event attorneys’ fees; and (c) under no circumstances will any entrant or winner be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
